Pre-Trial Diversion

About Pre-Trial Diversion


The Pre-Trial Diversion Program is a program offered to people who have had little or no criminal background and who are charged with
committing various misdemeanor offenses. This program is supervised by the Prosecutor’s Office.


The diversion will last for twelve months depending on your offense.
You will need to pay diversion program fees, court costs, obey all laws, and
complete other classes or programs depending on your offense.


If you are offered and accepted into the Diversion Program your case will be dismissed after the agreed upon time period (thereby avoiding a conviction) as long as the requirements and conditions specific to your agreement have been fulfilled.


Per IC 33-39-8-5 the Prosecutor will not enter into a Pre-Trial Diversion prior to an Initial Hearing if the defendant is not represented by counsel.
